 FRUSTRATED MAGISTRATE IMPRISONS ACCUSED PERSONS WHO QUESTIONED HER IMPARTIALITY

Alice Walusiku, one of the magistrates who were transferred from Lusaka a few months ago on Monday caused another shock when she revoked bail of accused persons simply because they asked her to recuse herself.

Magistrate ALICE WALUSIKU grudgingly recused herself from adjudicating over the legal battle on Ultimate Insurance Company shares.

From the onset, the defendants TOBIAS MILAMBO, NACHI MUSONDA and RICHARD LUBEMBA had asked the magistrate to stop hearing the case because they believe she was on the payroll of their enemy Chanda Katotobwe, a PF MP.

Despite being transferred from Lusaka, magistrate Walusiku clung on to this particular case. The accused persons also continued asking her to hand over the case to a neutral magistrate.

Finally yesterday, magistrate Walusiku said she would stop hearing that matter, and hand it to another magistrate.

But to punish the accused persons, she decided to revoke the bail that was granted to them last year. They spent last night in cells.

Magistrate WALUSIKU subsequently referred the case to LUSAKA Chief Resident Magistrate DOMINIC MAKALICHI for allocation to another magistrate.

Sometime last year, Magistrate Walusiku went to tell lies to LAZ that Jonas Zimba, the lawyer for the accused persons walked out of court. Based on this lie, LAZ suspended the lawyer. This was so shocking that it took Sakwiba Sikota, who was representing Katotobwe to write to LAZ to dispel the lie by this PF magistrate. LAZ had no choice but to restore the license for lawyer Zimba.

This is in a matter where the three defendants who are also Directors of Marshland Consortium are facing 15 counts of forgery, obtaining money by false pretenses and uttering false documents pertaining to Ultimate Insurance’s shareholding resolutions. The charges are brought by MP Chanda Katotobwe who did this to steal the company the real owners and in the process paid off judges.

The front/plaintiff in the matter is FELICITUS CHIBAMBA, the wife to LUSAKA Business man CHANDA KATOTOBWE who is also Patriotic Front-PF LUAPULA Member of Parliament.
